Florida House Bill 451
GENERAL BILL by Randolph
Sterilization of Dogs and Cats: Requires sterilization of dogs & cats of specified age; provides exceptions; authorizes county or municipality to enact ordinances requiring licensure of dogs & cats that are not sterilized; requires DOACS to adopt rules for approval of breed registration organizations; provides penalties; conforms requirements for sterilization of dogs & cats in animal shelters & animal control agencies to changes made by act; deletes provision extending time for sterilization; authorizes county & municipal ordinances relating to sterilization of animals; authorizes county or municipality to collect surcharge on civil penalties.

Section 1. Section 828.35, Florida Statutes, is created to 40 read: 41 828.35 Sterilization of dogs and cats; exceptions; 42 penalties.-- 43 (1) The owner of every dog or cat in this state must 44 provide sterilization of the animal by a veterinarian licensed 45 under chapter 474 within 30 days after the animal reaches 4 46 months of age or 30 days after the owner takes custody of the 47 animal, whichever occurs later. This subsection does not apply 48 to an animal exempt from sterilization under subsection (2). 49
(2)(a) A dog or cat is exempt from sterilization if a 50 licensed veterinarian has examined the animal and has certified 51 in writing that, at the time of examination, sterilization would 52 endanger the animal's health because of its age, infirmity, 53 disability, illness, or other medical consideration. An exempt 54 animal must be sterilized as soon as its health permits, except 55 as otherwise provided in this subsection. 56
(b) The governing body of a county or municipality is 57 authorized to enact ordinances that require the licensure of the 58 following animals that shall be exempt from sterilization: 59 1. A show animal registered with an established breed 60 registration organization approved by the Division of Animal 61 Industry of the Department of Agriculture and Consumer Services. 62 The department shall adopt rules under ss. 120.536(1) and 120.54 63 to administer this subparagraph. 64 2. A dog or cat that has earned, or is in the process of 65 earning, a competitive sports or training title, including, but 66 not limited to, agility, obedience, or herding. 67 3. An animal trained, or in training, for use as a guide 68 dog or service animal. 69 4. A dog trained, or in training, for use in law 70 enforcement, military, or rescue activities. 71 5. An animal for which the owner has a valid breeding 72 permit issued in accordance with an ordinance of the county or 73 municipality. 74 (c) A greyhound racing dog that currently participates in 75 racing at a licensed parimutuel facility is exempt from 76 sterilization. An exempt animal must be sterilized upon 77 retirement from racing, except as otherwise provided in this 78 subsection.

thank you. I dont see a problem with it, providing responsible breeders (for show and trial) are allowed to breed. I completely agree with a breeding license being necessary. the same for assistance dogs and police dogs. if exceptions are allowed, then I agree with it. _________________
