Felony Custodial Arrest
- An officer should make a custodial arrest when
there is evidence of torture, skinning, fighting, etc.
pursuant to laws defining animal felony cruelty
cases
- Always notify the BPD Cruelty Detective on all
felony arrests
- Notify BJC Animal Control to Confiscate the
Animal

- An officer should make a custodial arrest when
there is evidence of torture, skinning, fighting, etc.
pursuant to laws defining animal felony cruelty
cases
- Misdemeanor Custodial Arrest - It is recommended
that an officer make a custodial arrest for misdemeanor
animal cruelty (typically neglect) if and only if the
officer believes the degree of the offense is life
threatening. BEFORE MAKING AN ARREST, ALWAYS NOTIFY THE BPD
DETECTIVE AND REMEMBER PICTURES MUST BE TAKEN. A DECISION
TO CONFISCATE THE ANIMAL SHOULD BE LEFT TO THE
DETECTIVE.

Any law enforcement officer or agent of the county/municipality may order the owner of the dog/cat to provide certain care (humane standards, i.e., shelter, food, water or medical attention) at the owner's expense.
