Petfinder Interface Access and Data Use Terms of Service

In exchange for access to the data owned or otherwise licensed by Petfinder (the "Data") that Petfinder is making available to you through this programming interface you ("You") hereby agree to the following terms and conditions:

(1) You agree to comply with the terms of Petfinder's Visitor Agreement available at http://corporate.discovery.com/visitor-agreement/ (the "Visitor Agreement") and you understand that the requirements of this Petfinder Interface Access and Data Use Terms of Service Agreement supplements the Visitor Agreement and you are required to comply with both agreements; and

(2) You are only authorized to use the Data to develop applications and widgets that promote adoptable pets and shelters; and

(3) You are not permitted to change, alter or otherwise manipulate the pet data, description or shelter data within the Data in any way; and

(4) You agree that you are not authorized to use the Data for any commercial purpose, including, without limitation, any sale of the Data to any third parties or any sale of advertising around the Data; and

(5) You are required to credit Petfinder as the source of the data within any applications that you develop using the Data by including "Powered by Petfinder.com" and to include a link to the Petfinder website at www.petfinder.com; and

(6) Without the express written consent of Petfinder in each instance, you are not permitted to use the Petfinder logo and/or other Petfinder trademarks in any way not expressly allowed by these Terms of Service and you may not use the Petfinder name in your application name.

(7) Petfinder may terminate your access to the Data and use of the Data immediately at any time in Petfinder's sole discretion for any reason, and in such event YOU agree to stop any and all uses of the Data immediately; and

(8) THE DATA IS PROVIDED TO YOU AS IS, WITH ALL FAULTS, AND AS AVAILABLE. PETFINDER ONLINE ADMINISTRATION, INC. AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS AND LICENSORS CANNOT AND DO NOT WARRANT THE ACCURACY, COMPLETENESS, CURRENTNESS, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE OF THE DATA, NOR DO THEY GUARANTEE THAT THE DATA WILL BE ERROR-FREE OR CONTINUOUSLY AVAILABLE. UNDER NO CIRCUMSTANCES WILL PETFINDER ONLINE ADMINISTRATION, INC., ITS PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS OR LICENSORS BE LIABLE TO YOU OR ANYONE ELSE FOR ANY DAMAGES WHATSOEVER ARISING OUT OF YOUR USE OR POSSESSION OF THE DATA, INCLUDING, WITHOUT LIMITATION, LIABILITY FOR CONSEQUENTIAL, SPECIAL, INCIDENTAL, INDIRECT OR SIMILAR DAMAGES, EVEN IF ADVISED BEFOREHAND OF THE POSSIBILITY OF SUCH DAMAGES. (BECAUSE SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN CATEGORIES OF DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU. IN SUCH STATES, THE LIABILITY OF PETFINDER ONLINE ADMINISTRATION, INC. AND ITS PARENTS, SUBSIDIARIES, AFFILIATES, AGENTS AND LICENSORS IS LIMITED TO THE FULLEST EXTENT PERMITTED BY SUCH STATE LAW.); and

(9) You agree to indemnify, defend and hold harmless Petfinder Online Administration, Inc. and its parents, subsidiaries, affiliates, agents and licensors and each of their officers, directors, employees and agents from and against any and all losses, expenses, damages and costs (including reasonable attorneys' fees) resulting from any violation of this Petfinder Interface Access and Data Use Terms of Service Agreement.
