Thanksgiving "Happy Tails" Contest
OFFICIAL RULES

NO PURCHASE NECESSARY. VOID WHERE PROHIBITED. OFFERED ONLY TO LEGAL RESIDENTS OF THE 50 UNITED STATES AND THE DISTRICT OF COLUMBIA ("U.S."), AGED 18 YEARS OR OLDER.

1. ELIGIBILITY: Thanksgiving "Happy Tails" Contest ("Contest") is open to legal U.S. residents who are 18 years of age or older at time of entry. Employees, officers and directors of Discovery Communications, LLC ("Sponsor"), Pefinder.com, its promotional partner BISSELL, Inc., their parent companies, subsidiaries, affiliates, TV production partners, advertising agencies, promotional suppliers and the immediate family members (spouses and parents, children and siblings and their spouses, regardless of where they live) or members of the same households (whether related or not) of such employees, officers and directors (collectively, "Contest Entities") are not eligible. All applicable federal, state, and local rules apply. Void in Puerto Rico and where prohibited or restricted by law.

2. CONTEST DESCRIPTION: To participate in the Contest, you must submit a written story of no more than 150 words on the subject of why you are grateful for having an adopted pet in your life and a photo of your pet that conveys joy of the human-animal bond. All of the Contest entries will be judged during the First Round of Judging (as described herein) and the five (5) top-scoring Finalists will be invited to participate in the People's Choice Voting Round, during which the public will vote to determine the Grand Prize winner and one (1) Runner-up winner.

3. TO SUBMIT AN ENTRY: The Contest begins at 12:01 PM Eastern Time ("ET") on November 12, 2008, and ends at 11:59 PM ET on November 27, 2008 ("Contest Period"). To enter, visit www.petfinder.com/thanksgivingtails to access the Contest entry page. Complete the online entry form by submitting the requested information and a story of 150 words or less which describes how you are grateful for having your adopted pet and how the pet has impacted your life in a positive and unique way. You will then be given directions on how to upload the photo of you and your pet. To be eligible for the First Round of Judging, your photo must meet the following requirements:

• The photo may be in color or in black and white, must be only in GIF (.gif) or JPEG (.jpg) format and may not exceed a file size of 4 megabytes. Files exceeding the maximum size will not be accepted.
• You must own all rights in the photo.
• The photo must contain a picture of your pet.
• If any third person appears in the photo, you must know the names and addresses of that person(s), and must have permission from him or her to submit the photo. Sponsor may require such a person to provide a release of liability and publicity release.
• The photo must not contain any trademark, name, logo, product or slogan that is owned by a third party.
• The photo must not contain any derogatory, immoral, profane, obscene, pornographic, defamatory or otherwise objectionable content.
• The photo must not violate the publicity or privacy rights of any other individual, whether deceased or living.

If your photo meets the above requirements, you may submit it as described above. It must be received by Sponsor's server by 11:59 PM ET on November 27, 2008. Other than for winner notification, neither Sponsor, nor anyone acting on its behalf, it is not obligated to enter into any communication with any entrant regarding this Contest, nor will entries be acknowledged or returned.

You may enter as often as you wish, but each entry must be different, must meet all entry requirements and must be submitted separately. Entries must be completed in English.

4. OWNERSHIP OF PHOTO & GRANT. By entering you warrant and represent that your entry is your own original work created by you, is true and verifiable, has not been previously published, has not won a previous prize or award, that you own or otherwise control all of the rights to your entry materials and that your entry does not violate any law, regulation or any right of any third-party, including but not limited to rights of copyright, publicity and privacy. Submitting an entry that is copyrighted by another individual will make you responsible for any legal action the legal copyright holder might take action against you.

Entrants grant the Sponsor all rights of ownership, reproduction, and use of entries for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-free, worldwide right, in all media (now known or later developed) to assign, use, publish, edit, adapt, modify, alter, reproduce, distribute, display, copyright, create derivative works or otherwise exploit entries, for commercial or non-commercial use, and without compensation to the entrant. By entering the Contest, each entrant waives any and all rights he or she may have to the photograph.

Periodically throughout the Contest Period, Petfinder.com may, at its sole discretion, select photos, captions and stories to be featured online at www.petfinder.com. Being so selected will have no bearing on whether an entry is chosen as a Finalist once the initial Contest judging is complete.

5. FIRST ROUND OF JUDGING: Entries will be judged initially by the Contest Administrator (Petfinder.com) based on the following judging criteria: Relevance to originality (25%), relevance to Contest theme (50%) and appeal and promotion of pet adoption (25%). The five (5) entries receiving the highest scores will be declared the Finalists. The names, photos and captions of the Finalists will be posted at www.petfinder.com/thanksgivingtails as part of the People's Choice Voting.

6. FINALIST NOTIFICATION AND ACCEPTANCE: The five (5) potential Finalists will be advised of their having been selected by email and/or telephone on or about December 15, 2008, and may be required to sign and return a release form indicating their compliance with the Contest rules and confirming that their Contest entry is original and that they have all necessary rights in the entry as set out in these Contest rules. In addition, Sponsor may ask the potential Finalist to provide a signed release for any identifiable person shown in the photograph. In the event that a potential Finalist cannot be contacted, does not return the release form or forms within the prescribed time or chooses to waive his/her right to compete in the People's Choice Voting, that potential Finalist will forfeit his/her position as a Finalist and the entrant with the next highest score will be selected.

7. PEOPLE'S CHOICE VOTING ROUND: On December 14, 2008, the five (5) Finalist entries will be displayed on the Contest site at www.petfinder.com/thanksgivingtails, to be voted upon by the public. Visitors to the site may vote between 12:01 PM ET on December 14, 2008, and 11:59 PM ET on December 19, 2008, for the Finalist whose entry, in the voters' opinion, best reflects the joys of adopting a homeless pet. Limit one vote per person per day.

The Finalist receiving the most votes will be named the Grand Prize winner. The Finalist receiving the next-highest score will be named Runner-Up. If for any reason the winners cannot be selected through People's Choice Voting, including without limitation, as a result of a tie between/among the Finalists, insufficient or ineligible entries, voting, or any other reason, Contest Administrator shall select the winners based upon the judging criteria identified in Section 5.

8. WINNER NOTIFICATION/PRIZES: The winners will be notified by email on or about December 29, 2008, and will be required to complete an affidavit of eligibility, a liability release, and (where legal) a publicity release, which must be returned by date specified in notification letter or an alternate winner may be selected. If a winner is 18 years of age or older as is required for entry but is not of the age of majority in his/her state of residence, prize will be awarded in the name of his/her parent or legal guardian.

One [1] Runner-Up Prize: a Petfinder black hooded sweatshirt - $24.95 value, a Petfinder.com Cat-or Dog-Adoption Fitted Tee - $16.95 value, a Petfinder.com Gym Bag - $14.95 value and two Petfinder.com bumper stickers.

Total Approximate Retail Value of Grand Prize: $56.85 value

Odds of winning any prize depend on the number of eligible entries.

9. PRIZE CONDITIONS: All taxes on prizes and all expenses related to acceptance and use of the prizes not specified are the sole responsibility of winners. No prize transfer or cash redemption. No prize substitution, in whole or in part, except by Sponsor due to prize unavailability, safety or security considerations, or any other reason as solely determined by Sponsor, in which case a prize of comparable or greater value will be awarded.

10. RELEASE AND INDEMNITY & GENERAL CONDITIONS: By participating, entrants agree: [a] to these rules and decisions of Sponsor and Contest Administrator, which shall be final in all respects relating to the Contest; and [b] to release, discharge, hold harmless and indemnify Contest Entities from any and all injuries, liability, losses and damages of any kind resulting from their participating in the Contest or their acceptance, use or misuse of a prize including, without limitation, personal injury, death and property damage, and claims based on publicity rights, copyright, trademark, defamation or invasion of privacy. Entrants agree to grant Sponsor: [a] all rights of ownership, reproduction and use of Contest entry for any purpose whatsoever without compensation or further permission, including but not limited to an irrevocable and perpetual, royalty-fee, worldwide right, in all media (now known or later developed) to assign, use, publish, edit, adapt, modify, alter, reproduce, distribute, broadcast, display, copyright, create derivative works or otherwise exploit entries, for commercial or non-commercial use; and if a winner, [b] to permit Contest Entities to use his or her name, photograph, likeness, Contest entry, biographical information, voice, voice likeness, and city and state address for advertising, publicity and promotional purposes in all media, including but not limited to within Sponsor's website www.petfinder.com/thanksgivingtails, in perpetuity, without compensation (unless prohibited by law) and agree to execute specific consent to such use upon request. Contest Entities are not responsible for and shall not be liable for: [a] any telecast, cable or telephone malfunctions, human error, satellite transmission failures, or delayed telecasts or preemption of or the failure of a cable affiliate to televise Animal Planet® or any affiliated Sponsor network in all or any parts of the United States; [b] electronic, hardware or software program, network, Internet or computer malfunctions, failures, or difficulties of any kind, including without limitation, server malfunction or by any human error which may occur in the processing of entries; [c] failed, incomplete, garbled or delayed computer transmissions; [d] late, lost, misdirected or incomplete entries; or [e] any condition caused by events beyond the control of the Sponsor that may cause the promotion to be disrupted or corrupted.

11. RIGHT TO CANCEL, MODIFY OR DISQUALIFY: Sponsor reserves the right in its sole discretion to cancel, terminate, modify or suspend the Contest or any portion thereof should viruses, bugs or other causes beyond the control of Sponsor corrupt the administration, security or proper play of the Contest, and limit entries to those submitted prior to the action taken, or to proceed in such a manner as may be deemed fair and equitable by Sponsor in its sole discretion and to award the prizes from all eligible entries received prior to such action taking place. Sponsor reserves the right in its sole discretion to disqualify any entry at any time which, in the Sponsor's reasonable opinion, endangers the safety or well being of any person or in the event it is determined that the entrant has not complied with these Official Rules.

12. INTERNET: CAUTION: ANY ATTEMPT BY AN ENTRANT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW. Internet entry must be made by the Entrant only at the authorized web site address of www.petfinder.com/lookalike. Entries may not be made by any other individual or any entity, and/or originating at any other Internet website or e-mail address, including but not limited to commercial contest and sweepstakes subscription notification and/or entering service sites. Any person who enters or votes by any of the methods described above will be disqualified. Use of any device to automate entry or voting is prohibited. Sponsor reserves the right in its sole discretion to disqualify any entry or vote at any time in the event it is determined that the Entrant or voter has not complied with these Official Rules. Sponsor reserve the right to cancel this Contest in the event it learns that fraudulent voting has occurred, or in the event that any participant or voter has not complied with these Official Rules.

13. GOVERNING LAW. This Contest is governed by the laws of the State of Maryland, with jurisdiction and venue in Montgomery County, Maryland, and all claims must be resolved in the courts of Montgomery County, Maryland.

14. ENTRY INFORMATION: Please note that by entering this Contest and by checking the "opt-in" boxes on the entry form for this promotion, you are [a] agreeing that the Sponsor may share your entry information (including your name, address, email address, etc.) with our promotional partners and other parties; and [b] granting us, our promotional partners and other third parties with which we choose to share your information, permission to contact you about our upcoming shows, promotions or for other reasons. The collection and use of entrant information will be governed by Discovery's on-line privacy policy, available for viewing at http://animal.discovery.com/utilities/about/privacypolicy.html.

15. WINNER LIST: For a list of winners, mail a self-addressed, stamped envelope to be received by January 31, 2009, to: Petfinder Thanksgiving "Happy Tails" Contest, 13212 N Classic Overlook Ct., Oro Valley, AZ 85755-1904. Residents of Vermont need not supply postage.
